Ex parte Mieth, No. 02-0005-360 (July 20, 2006) (Dauphinot, J., joined by Cayce, C.J., and Gardner, J.).
Held: Appellant’s state and federal constitutional rights against double jeopardy were not violated when he was prosecuted for an offense after the evidence thereof had already been admitted during punishment in a previous case.
