Capital One, Nat'l Ass'n v. Carter & Burgess, Inc.,   No. 02-10-00025-CV    (May 19, 2011)   (Meier, J., joined by Gardner and Gabriel, JJ.).
Held:   The trial court did not abuse its discretion by concluding that CONA's claim against C&B for negligent misrepresentation was one for damages arising out of the provision of professional services or that the acts of which CONA complains were performed by a licensed or registered professional. The trial court also did not abuse its discretion by dismissing CONA's claims for statutory fraud and aiding and abetting fraud because those claims were not claims other than ones for negligence.
