In re Tex. Collegiate Baseball League, Ltd., No. 02-12-00048-CV (Apr. 5, 2012) (Gardner, J., joined by Walker and Meier, JJ.).
Held: The trial court abused its discretion by denying the relators' amended motion to abate, and the relators do not have an adequate remedy by appeal. Severance or separate trials of the opposing attorney-fee claim and legal malpractice claims would not alleviate and might actually increase the risk of harm or prejudice to the relators, and failing to abate could lead to the parties having essentially the same trial twice but with the relators defending the attorney-fee claim at the first trial with unripe defenses.
