In re Leonard , No. 02-13-00081-CV (June 6, 2013) (orig. proceeding) (Gardner, J., joined by Walker and McCoy, JJ.).
Held: The trial court did not have jurisdiction to extend the term of Relator's term of community supervision in December 2012 because Relator's original five-year term of supervision expired in November 2009 while his appeal from the adjudication of his guilt remained pending. Estoppel cannot apply because the trial court's action is one involving subject matter jurisdiction rather than the trial court's authority to act.
