Big Rock Investors Ass'n v. Big Rock Petroleum, Inc., No. 02-12-00396-CV (Aug. 15, 2013) (Walker, J., joined by Gardner and McCoy, JJ.).
Held:  The trial court did not err by granting Appellees Big Rock Petroleum, Inc. and J.A. McEntire, III's plea to the jurisdiction and dismissing the claims that Appellant Big Rock Investors Association (BRIA) filed against Appellees because BRIA does not possess associational standing or standing as an agent.
D&M Marine, Inc. v. Turner, No. 02-12-00399-CV (Aug. 15, 2013) (Gabriel, J., joined by Livingston, C.J., and Meier, J.).
Held:  The judgment debtor's unasserted claim for indemnification against its insurer was the proper subject of a turnover order in favor of the judgment creditor. The judgment debtor waived voidable error in the turnover order, which improperly ordered assets surrendered directly to the judgment creditor instead of to the sheriff, constable, or receiver.
