O P I N I O N



This is a post-conviction application for a writ of habeas corpus filed pursuant to Article 11.07, V.A.C.C.P. Applicant was convicted of possession of more than four grams of methamphetamine with intent to manufacture and punishment was assessed at thirty years imprisonment. No appeal was taken from this conviction.

Applicant contends that he did not receive credit for all the time he was confined in this cause. The trial court has entered findings, supported by the record, that Applicant was confined in the Wichita County Jail with a detainer for this cause lodged from November 2, 1999, to January 7, 2000, and has not received credit in this cause for that confinement. Applicant is entitled to relief.

Relief is granted. The Texas Department of Criminal Justice, institutional division, shall credit Applicant's sentence in cause number 9765 in the 46th Judicial District Court of Wilbarger County for the additional period from November 2, 1999, to January 7, 2000.

Copies of this opinion shall be sent to the Texas Department of Criminal Justice, institutional and pardons and paroles divisions.
