Saldivar v. State, No. 02-05-00284-CR (Nov. 16, 2006)(mem. op.)(Holman, J., joined by Dauphinot and Gardner, JJ.).
Held: The trial court properly denied Appellant=s motion to suppress physical evidence found in the glove compartment of his vehicle. After police officer returned Appellant=s driver=s license and issued citations to him, Appellant was free to ignore or to refuse to answer a subsequent question about whether his vehicle contained any other illegal items. Instead, Appellant said Ayes,@ then voluntarily told the officer that he had cocaine in his glove compartment and gave the officer permission to retrieve it.
