City of Argyle, Tex. v. Pierce,   No. 02-07-00255-CV   (May 15, 2008)   (McCoy, J., joined by Cayce, C.J., and Livingston, J.).
Held:   The trial court had jurisdiction where Appellees sought only a declaration that their conduct did not violate Appellant's sign ordinance and not a declaration of the ordinance's constitutionality or enforceability. However, Appellees failed to allege a valid inverse condemnation claim sufficient to defeat Appellant's governmental immunity.
