O P I N I O N



This is a post-conviction application for writ of habeas corpus filed pursuant to the provisions of Article 11.07, V.A.C.C.P. Applicant was convicted of forgery and was sentenced to one year in state jail. No appeal was taken from this conviction.

In his present application, Applicant contends that he is not receiving credit for the time that he spent in jail prior to trial. The trial court finds that applicant was confined in another county on a Jefferson County hold from July 9, 2002, until November 18, 2002, and he has not received credit for this time. The trial court finds that applicant was to receive credit for all time that he spent incarcerated prior to trial in this case, but this time was overlooked because the court clerk was unaware of the hold that had been placed on applicant. The trial court recommends granting relief. We agree.

Habeas corpus relief is granted to the extent that in cause number 83235 from the 252nd Judicial District Court of Jefferson County, the Texas Department of Criminal Justice, State Jail Division, is ordered to grant Applicant credit for the above-mentioned time period.

Copies of this opinion shall be sent to the Texas Department of Criminal Justice, State Jail Division.
