Pursuant to Texas Rule of Appellate Procedure 56.3, the Court severs the portion of the proceedings against Respondent Endeavor Energy Resources L.P. from case no. 23-0037 into case no. 23-0680, styled Occidental Permian, Ltd., Occidental Petroleum Corporation, Oxy USA, Oxy USA WTP LP, and Rodeo Midland Basin, LLC v. Endeavor Energy Resources L.P. Without considering the merits, the Court grants the petition for review in case no. 23-0680, vacates the court of appeals’ judgment as to the claims severed into that case, and remands that case to the trial court for rendition of a judgment in accordance with the parties' agreement. The remainder of the appeal in case no. 23-0037, restyled Occidental Permian, Ltd., Occidental Petroleum Corporation, Oxy USA, Oxy USA WTP LP, and Rodeo Midland Basin, LLC v. Citation 2002 Investment LLC remains pending before this Court.
