In re Fain, No. 02-17-00032-CV (Mar. 2, 2017) (Walker, J., joined by Meier and Gabriel, JJ).

Held:  We deny Relator’s petition for writ of mandamus asking that we compel the trial court to compel the State to be more pro-active in obtaining the results of DNA testing.  Although we have concerns regarding the lengthy delay in obtaining the results of the DNA testing, we lack mandamus jurisdiction because Relator has not requested any action from the trial court regarding the delay.
